Disclaimer / Terms

Information & Specification relating to aircraft and associated items on this site are in many cases supplied by owners, as such aircraft hours may change through use and specifications may change without notice. AT Aviation will not be held liable for any loss arising from information shown on our website or any other website representing AT Aviation. Any transactions undertaken on or through AT Aviation shall be at the sole risk of seller and purchaser and shall be carried out under UK Law Only. All aircraft are supplied with no express or implied warranty provided. Sales contracts, orders, invoices or payment requests will detail the terms of a purchase specifically. AT Aviation Sales ltd nor aircraft owners will by the complexed nature of Aviation be committed to timescales in any regard with any sale. This is due to many sales requiring 3rd party assistance which neither AT Aviation Sales ltd or an owner is able to control. It is accepted that all parties in regards to timelines will use best endeavours to provide a service or delivery as promptly as possible.

Any cancellation of a sale pre completion shall attract a 5% (of the sale price) restocking fee which will be deducted from any deposit previously paid. If a sale is cancelled when all payments have been completed the same restocking fee shall apply in additional to a 8% + VAT re sale commission and all disbursements as required charged at the rate set by AT Aviation Sales Ltd. Re sale period shall not be time limited but once activated by cancellation may not be cancelled or re assigned. AT Aviation advise a pre-purchase inspection on all aircraft sales and where possible viewing of aircraft and technical paperwork. The failure to do so will be at the buyers own risk and AT Aviation Sales ltd or the owner of the aircraft will not be held liable in any regard for any future claims. By signing any of our sales and purchase contracts / agreements including any issued by web or email or verbally constitutes acceptance of our / its terms and conditions.

Refundable deposits are available to secure aircraft off market for period of 21 days exclusivity. These are refundable only in the event of the aircraft not meeting the specification as described or an airworthiness fault being found during inspection. In the case of a fault being found at inspection the deposit shall only be refundable in the event of them owner not agreeing to correct the fault and cover all costs.

AT Aviation sales ltd provides buyers and sellers additional services which as disbursements are charged as required. Air safety is of paramount importance as well as providing professional and value for money services and solutions for both buyer and sellers. In regards to air safety both buyers and sellers accept that any defect or update required to complete a sale will be at the sole discretion of AT Aviation, costs being the responsibly of the owner / seller. Final bills of sale / invoice may from time to time reflect additional charges which do not form part of an owners obligation or benefits in sale. Any charges made are as per terms and conditions and have no set aside unless agreed in advance in writing. Sale completion is when the aircraft or other goods are formerly handed over and or collected. All costs up to completion remain the seller / owners responsibility as per published charges.

AT Aviation Sales Ltd provides part exchange services for those customers wishing upgrade aircraft with greater ease. Customers using part exchange services do so with the clear understanding that a part exchange price is based on the part exchange aircraft being in good order and ready for sale. Any part exchange aircraft shall be presented with all log books and associated paperwork and shall be defect free with all airworthiness directives applied up to date, along with any compulsory service bulletins applied. Accident damage and/or history must be disclosed by the seller and may, if not disclosed, render any transaction void. In the event that a part exchange aircraft is not as described or does not meet the above definition, AT Aviation reserves the right to revoke the part exchange offer price, cancel the transaction or at their discretion, adjust the part exchange figure by a sum deemed sufficient to remedy the matter and or defect. Any notice of variation / cancellation shall be notified in writing within 60 days following the aircraft survey for part exchange and final completion of a transaction. Completion is the date at which AT Aviation issues a final bill of sale and or invoice which notes acceptance of the part exchange aircraft by signing local CAA or FAA registration documents formally accepting ownership of the subject aircraft.

Our services are fully insured with public liability cover and hangar keepers protection but this does not include any mechanical warranty in any regard otherwise or implied.

Online / Remote listing broker Terms

When an aircraft is remotely listed with AT aviation Sales Ltd by its owner or agent via email or a verbal telephone instruction is made, the owner or agent accepts that the standard fee of 8% + VAT will be the charged for the firms services, and that the listing will be exclusive for a minimum term of 180 days. The minimum sales fee shall be £2500 + VAT. Termination can be applied with 30 days notice after the primary period. Any sale made to a buyer introduced by AT Aviation Sales Ltd after the listing period shall still be chargeable at the prevailing rate, no time limitation applicable. Disbursements connected to a sale will be charged and paid as reasonably expected. All fees due to AT Aviation Sales Ltd are to be paid within 7 days of invoice unless otherwise agreed.

In the event of a contracted sale or sales agreement being adversely effected, cancelled or impeded by a sellers insolvency, AT Aviation shall hold the aircraft and or its records until such time that all costs related to the aircraft are fully paid by the sellers estate, and or insolvency agent. These costs include but are not limited to maintenance costs, and or secure storage charges of which are noted in the companies terms and conditions.

Non-Circumvention, Non-Disclosure Agreement

All buyers, sellers and brokers accept that under no circumstances shall they Circumnavigate AT Aviation Sales ltd in any way. Fee’s as published are payable for all aircraft and goods sold as listed via AT Aviation up to an including the termination period as per terms and conditions.

Copyright

Artwork on this website has been either made or photographed by ATA and own the copyright, imagery taken by owners of aircraft own the copyright, they must be notified before use of any sort ( electronically or paper media ).

Imagery used from what seems to be the public domain will have a photographers name included on the imagery and will only be used on our site if we have exhausted all options to contact the copyright owner, they will still be classed as the owner of the image used and they must also be contacted where possible before use of there imagery.

Privacy

Your privacy is critically important to us. At AT Aviation we have a few fundamental principles:
We don’t ask you for personal information unless we truly need it.

We don’t share your personal information with anyone except to comply with the law, develop our products, or protect our rights.

We don’t store personal information on our servers unless required for the on-going operation of one of our services.

AT Aviation Sales Ltd. (“ATA”) operates several websites. It is ATA’s policy to respect your privacy regarding any information we may collect while operating our websites.

Website Visitors

Like most website operators, ATA collects non-personally-identifying information of the sort that web browsers and servers typically make available, such as the browser type, language preference, referring site, and the date and time of each visitor request. ATA’s purpose in collecting non-personally identifying information is to better understand how ATA’s visitors use its website. From time to time, ATA may release non-personally-identifying information in the aggregate, e.g., by publishing a report on trends in the usage of its website. ATA also collects potentially personally-identifying information like Internet Protocol (IP) addresses for logged in users and for users leaving comments on Contact Us or Aircraft Information Request Forms. ATA only discloses logged in user and Aircraft Information Request Forms commenter IP addresses under the same circumstances that it uses and discloses personally-identifying information as described below, except that Aircraft Information Request Forms commenter IP addresses and email addresses are visible and disclosed to the administrators of the Aircraft Information Request Forms where the comment was left.

Gathering of Personally-Identifying Information

Certain visitors to ATA’s websites choose to interact with ATA in ways that require ATA to gather personally-identifying information. The amount and type of information that ATA gathers depends on the nature of the interaction. For example, we ask visitors who sign up for our Notification Service to provide a username and email address and phone number. Those who engage as necessary the personal information required to process this action. In each case, ATA collects such information only insofar as is necessary or appropriate to fulfil the purpose of the visitor’s interaction with ATA. ATA does not disclose personally-identifying information other than as described below. And visitors can always refuse to supply personally-identifying information, with the caveat that it may prevent them from engaging in certain website-related activities.

Aggregated Statistics

ATA may collect statistics about the behaviour of visitors to its websites. For instance, ATA may monitor the most popular Aircraft or use spam screened by a service to help identify spam. ATA may display this information publicly or provide it to others. However, ATA does not disclose personally- identifying information other than as described below.

Protection of Certain Personally-Identifying Information

ATA discloses potentially personally-identifying and personally-identifying information only to those of its employees, contractors and affiliated organisations that (i) need to know that information in order to process it on ATA’s behalf or to provide services available at ATA’s websites, and (ii) that have agreed not to disclose it to others. Some of those employees, contractors and affiliated organisations may be located outside of your home country; by using ATA’s websites, you consent to the transfer of such information to them. ATA will not rent or sell potentially personally-identifying and personally- identifying information to anyone. Other than to its employees, contractors and affiliated organisations, as described above, ATA discloses potentially personally-identifying and personally- identifying information only in response to a subpoena, court order or other governmental request, or when ATA believes in good faith that disclosure is reasonably necessary to protect the property or rights of ATA, third parties or the public at large. If you are a registered user of an ATA website and have supplied your email address, ATA may occasionally send you an email to tell you about new features, solicit your feedback, or just keep you up to date with what’s going on with ATA and our services. We primarily use our various products, mailers & blogs to communicate this type of information, so we expect to keep this type of email to a minimum. If you send us a request (for example via a support email or via one of our feedback mechanisms), we reserve the right to publish it in order to help us clarify or respond to your request or to help us support other users. ATA takes all measures reasonably necessary to protect against the unauthorised access, use, alteration or destruction of potentially personally-identifying and personally-identifying information.

Cookies

A cookie is a string of information that a website stores on a visitor’s computer, and that the visitor’s browser provides to the website each time the visitor returns. ATA uses cookies to help ATA identify and track visitors, their usage of ATA website, and their website access preferences. ATA visitors who do not wish to have cookies placed on their computers should set their browsers to refuse cookies before using ATA’s websites, with the drawback that certain features of ATA’s websites may not function properly without the aid of cookies.

Business Transfers

If ATA, or substantially all of its assets, were acquired, or in the unlikely event that ATA goes out of business or enters bankruptcy, user information would be one of the assets that is transferred or acquired by a third party. You acknowledge that such transfers may occur, and that any acquirer of ATA may continue to use your personal information as set forth in this policy.

Ads

Ads appearing on any of our websites may be delivered to users by advertising partners, who may set cookies. These cookies allow the ad server to recognise your computer each time they send you an online advertisement to compile information about you or others who use your computer. This information allows ad networks to, among other things, deliver targeted advertisements that they believe will be of most interest to you. This Privacy Policy covers the use of cookies by ATA and does not cover the use of cookies by any advertisers.

Comments

Comments and other content submitted to our anti-spam service are not saved on our servers unless they were marked as false positives, in which case we store them long enough to use them to improve the service to avoid future false positives.

Privacy Policy Changes

Although most changes are likely to be minor, ATA may change its Privacy Policy from time to time, and in ATA’s sole discretion. ATA encourages visitors to frequently check this page for any changes to its Privacy Policy. If you have a AT Aviation Notification account, you should also check your blog’s or news for alerts to these changes.
